Rental Terms and Conditions
BOOKING
The tenant receives a rental confirmation by email.
Within 7 days after receiving this rental confirmation, a deposit of 50% of the rental amount must be transferred. This amount is stated on the rental confirmation and must be transferred to account BE21 7310 6753 4203 in the name of Claes-Sanders. After receipt of payment, the reservation is final. By making the reservation, these general terms and conditions come into effect. If payment is not received within 7 days, the reservation option expires.
The remainder of the rental amount + security deposit must be received no later than 6 weeks before the start of the rental period. If this has not taken place, the tenant will receive an email requesting payment of the amount within 5 working days. If payment still does not occur, this will be considered as a cancellation of the accommodation by the tenant and the cancellation conditions of article 3 apply. The landlord then has the right to offer the accommodation for rent again.
When booking within 6 weeks before the start of the rental period, you must pay the total rent + security deposit immediately.
Unless otherwise agreed, you can enter the accommodation on the arrival day from 4:00 PM and on the departure day you must leave the vacation rental before 10:00 AM (except on Sunday, when departure time is 6:00 PM).
RENTAL COSTS
The rental amount concerns the rental of the house as stated on the website. The rent includes bed linens, final cleaning, wireless internet and normal consumption of water, electricity and gas.
Excessive consumption may be charged at the applicable rates at that time. In case of exceptional increases in energy prices, the landlord may still charge a surcharge for energy consumption. This surcharge will, if applicable, be communicated before the start of the stay.
The tenant will limit energy consumption by closing windows and doors when heating is on, and not wasting water or electricity.
For electric vehicles, you will find a charging station 4km away. It is not permitted to charge a vehicle on site.
When leaving the accommodation, the house must be returned in neat condition (tidy and broom-clean). Used household appliances (oven, cooktop, BBQ…) must be cleaned. Used bed and bath linens should be collected in the entrance hall downstairs. Failure to comply with these conditions may result in additional cleaning costs of 25 euros/hour.
Security deposit: the vacation home and surroundings must be used with care and in accordance with their intended purpose. For this, we require a mandatory security deposit of €300 for the stay. This security deposit will be refunded after deduction of any damage/additional consumption within 3 weeks after the rental period. If damage exceeds the security deposit amount, the tenant is obligated to make an additional payment within one week of notification.
CANCELLATION CONDITIONS
The tenant can cancel in writing, within a cooling-off period of 7 days after reservation, free of charge.
Rebooking: up to 6 months before arrival you can change the dates of your booking once, subject to payment of an administrative fee of €30 (new booking for stay within 12 months after the change).
In case of cancellation by the tenant, the following costs apply (these also apply to cancellation due to force majeure):
- Cancellation up to the 30th day before the day of arrival: 50% of the rental price.
- Cancellation from the 30th day until the day of arrival or later: the full rental price.
When the stay cannot proceed due to measures imposed by government authorities, the cancellation conditions also apply. We therefore advise taking out travel and/or cancellation insurance so that, if you are forced to cancel or prematurely terminate your vacation due to circumstances or force majeure, you can recover your funds. Contact your insurance agent in time for adequate coverage.
A change or cancellation by the tenant must always be communicated in writing or by email stating name and rental period.
Cancellation by the landlord: If circumstances force the landlord to cancel the stay, this will be immediately communicated to the tenant and the rental agreement becomes void. In this case, the landlord will refund the amount already paid by the tenant within 48 hours after the aforementioned notification. In this case, the tenant has no other right than to reclaim the amounts already paid and expressly waives further rights.
The landlord reserves the right to cancel the rental agreement in case of incorrect personal data.
HOUSE RULES
During the rental of the vacation accommodation, the specific house rules as communicated by the owner apply, as well as the following general house rules:
The rental periods:
- Weekend: from Friday 4:00 PM to Sunday 6:00 PM
- Midweek: from Monday 4:00 PM to Friday 10:00 AM
- Week: From Monday 4:00 PM to Sunday 6:00 PM or from Friday 4:00 PM to Friday 10:00 AM
- There are no pets allowed in our vacation home.
- A smoking ban applies in the vacation home, including electronic cigarettes and vapes. The use of drugs or laughing gas is not permitted on the premises.
- The vacation home is not rented for bachelor parties, student celebrations or other excessive drinking parties.
- In the accommodation, the use of gourmet, fondue, deep fryer or similar cooking methods is not permitted.
- When booking under false pretenses, the deposit/security deposit will be withheld and the tenant will not gain access to/be denied access to the vacation accommodation.
- In case of fire, you must leave the building as quickly as possible and notify the fire department (call 112) and the owner. For a small fire, you can first attempt to extinguish it yourself with the fire extinguishers provided.
- A guest must have a mobile phone so that emergency services can be notified.
- It is not permitted to occupy the accommodation with more than the stated maximum number of persons (8 persons). Extra tents, caravans or motorhomes are also not permitted without permission from the landlord. Children under 2 years are not counted as full persons, but must be mentioned in advance.
- Household waste must be correctly sorted into the bins provided for this purpose.
LIABILITY
The tenant undertakes to treat the rented property as a good householder. In case of nuisance and/or damage to the house or inventory, or failure to comply with house rules, you risk having to leave the vacation home.
As landlord, we have no liability for theft, loss or damage to or of property or persons, of any nature whatsoever, during or as a result of a stay in our vacation home.
As landlord, we are not liable for disruptions in service or defects in services provided by third parties.
The tenant is liable for all loss and/or damage to the rented accommodation and/or other properties of the landlord arising during use thereof by you and/or other users, regardless of whether this is the result of action or omission by yourself and/or third parties who are in the house with your permission.
All damage must be reported to the landlord before the tenant’s departure.
COMPLAINTS
Complaints regarding inventory and (existing) damage or defects must be reported immediately at 0032 456 013 440 or by email via info@lafenderie.fr, so that the landlord has the opportunity to resolve the complaint. If it subsequently appears that the tenant has not reported the error or imperfection, they lose the right to any restitution.
OTHER
French law applies to the rental agreement.
All information on the La Fenderie website (www.lafenderie.fr) is deemed to be provided in good faith and is always subject to interim adjustments. The landlord is not bound by obvious errors on their website.
